Anderson County Internal Auditor - Appropriate relationship to Council and Administrator
Does anyone have an opinion on the following?:
“Anderson County Council to assert itself at Feb. 3 meeting”
http://independentmail.com/news/2009/feb/01/anderson-county-council-assert-itself-feb-3-meetin/
“Two of those ordinances would require the internal auditor for the county and the county attorney to report to the county council, instead of to the county administrator. The council members instead of the administrator, according to the proposed ordinance language, would appoint those positions.”
Letter from SC Attorney General to Anderson County AttorneyTom Martin dated April 4, 2008

Conclusion
“Based upon prior opinions of this Office, we believe the Anderson County Administrator, not the Anderson County Council, must employ and supervise internal auditors.”
JK
It is clear that they ignore legal advice when they dont agree with it.
I definitely have an opinion on all this new council's fiasco of leadership, but JD has warned me about inappropriate language!!!
Actually, the county already has an auditor...why cant jackie Hunter do all this for free? He would be able to report to CC without any interference from the adminstrator

Perhaps you may want to read the duties of the County Auditor before you make such a post. The specific duties and powers of the auditor are spelled out in Title 12, Chapter 39 of the Code of Laws. It is online.
If it's an "independent" auditor you're looking for, no elected official is ever independent of the partisans who put him or her in office. It's why Home Rule says any "independent" internal auditor hired by the county should answer to the County Administrator, not to Council.
Of course, as little as the current Anderson County Council cares for Home Rule, they might as well make Bob Waldrep or Cindy Wilson the "independent" auditor. Nothing surprises anymore.
Thank you for making my point. I know exactly what the duties of the auditor are. Its funny though how suddenly you want to follow the letter of the law when it applies to one of your own.
