Judge Keeps SC "I Believe" Plates Off The Roads

WILMINGTON, NC (2008-12-11) A federal judge in South Carolina has put the brakes on production of a Christian license plate featuring the words "I Believe" next a cross and stained glass window.

The judge issued a temporary injunction halting producing of the "I Believe" license plate after a lawsuit filed this summer claimed the plates were unconstitutional.

South Carolina's Lt. Governor Andre Bauer says drivers requesting the Christian plate should be able to share the road with those already displaying the state's secular plate displaying "In Reason We Trust."

"You know, it's amazing to me that atheists and non-believers can purchase a secular license plate that they requested, but that same first amendment right given to them they now deny to others who want to purchase a different type of license plate."

Americans United for Separation of Church and State sued the state claiming the plate favors Christianity. Its Director Barry Lind says the judge's order will keep religion off the roads.

"I think it makes it clear that the "I Believe" license plates are very unlikely to ever see the light of day in South Carolina."

Bauer says an appeal is likely.

The South Carolina Supreme Court has struck down these plates as of 6pm tonight, citing separation of Church and State applies clearly.  These will not be sold or manufactured for this state.

Do you have a source for this? There's nothing on the SC Supreme Court website about it. In fact, I couldn't even find where someone asked them to decide about the license plates.

...and, does the SC Supreme Court normally issue opinions on Sunday?

Someone filed a federal lawsuit a few months ago...is that what you're talking about?

Stringcheese, it was a ruling on Thursday by a Federal judge, not the S.C. Supreme Court. Heres's the link to the story from Friday edition of The State newspaper in Columbia.

The thread started with a news story about the federal case. That's why I was confused about ideaman's post.

I hate going to the Supreme Court's web site. I end up wasting hours there reading.....especially the attorney disciplinary cases. Laughing

The opinion of the judge is fairly weak, 4th Circuit will probably overturn, they already dealt with a case like this. Also they dealt with a case where SCV tags were involved which bore the battle flag. They ruled that the license plate is not government speech but merely notice of taxes paid, therefore the designs are 1st amendment symbolic speech.
