1-opinion, with all due respect, if the NEW County Council wants to absolutely guarantee that they'll wind up paying Joey Preston's entire contract - AND face charges for violating state law - all they have to do is try to REQUIRE him to put Gina Humphries on paid leave without any concrete evidence of wrongdoing.
S.C. Code of Laws:
SECTION 4-9-660. Authority of council and its members over county officers and employees.
Except for the purposes of inquiries and investigations, the council shall deal with county officers and employees who are subject to the direction and supervision of the county administrator solely through the administrator, and neither the council nor its members shall give orders or instructions to any such officers or employees.
Y'all just haven't thought this through yet, have you?

JD there is NOTHING in the law you quote that bars the county council from directing Mr. Preston to place Ms. Humphries on paid admin leave. The law you quoted simply bars them from placing her on leave directly without going through the administrator as the conduit. Yes it has been thought through. The admistrator serves at the pleasure of the Council and takes direction from them. Contrary to popular opinion, PAID ADMINISTRATIVE LEAVE is not a punishment!
